General Terms and Conditions:

Article 1 Definitions

1.1. "Guitarage" refers to the trading company registered in the trade register of the Chamber of Commerce East Netherlands, with KVK number 80604994.

1.2. "Customer" refers to any visitor of the web store, whether a natural person or legal entity, who places an order via www.guitarage.nl.

Article 2 Applicability

2.1. These general and delivery terms and conditions apply to all orders placed through the web store www.guitarage.nl.

2.2. Placing an order implies acceptance of the applicability of these terms and conditions.

2.3. Deviations from the provisions in these terms and conditions can only be made in writing, in which case the other provisions remain in full force.

2.4. All rights and claims, as stated in these terms and conditions and in any further agreements for the benefit of www.guitarage.nl, are also stipulated for the benefit of intermediaries and other third parties engaged by www.guitarage.nl.

Article 3 Changes

3.1. www.guitarage.nl has the right to change the general and delivery terms and conditions and the content of the website at any time.

3.2. www.guitarage.nl may adjust the prices of the items at any time. Price changes take effect from the moment of publication on the website and do not apply to orders that have already been placed at that time.

3.3. All information on this site is subject to printing, typing, and setting errors. www.guitarage.nl cannot be held to its offers if the customer could reasonably have understood that it was a mistake or typographical error.

Article 4 Force Majeure

4.1. If www.guitarage.nl cannot fulfill its obligations due to force majeure, the obligations will be suspended for the duration of the force majeure situation. After thirty days, both parties have the right to terminate the agreement by means of a written declaration, either wholly or partially, without the right to any (damage) compensation.

4.2. Force majeure includes all shortcomings that cannot be attributed to www.guitarage.nl.

Article 5 Prices

5.1. The prices stated for the offered products are in euros unless otherwise stated or agreed in writing.

5.2. All our items are margin items (thus not VAT items). No VAT is mentioned on the invoice for margin items. VAT is therefore not deductible.

Article 6 Order

6.1. The agreement between the customer and www.guitarage.nl comes into effect at the moment the customer places the order! The customer will immediately receive a confirmation of their order via email.

6.2. It is possible to reserve an item. Reserved items will be held by www.guitarage.nl for a maximum of 7 days. After these 7 days, reserved items will be made available for sale again.

6.3. www.guitarage.nl only sells vintage (second-hand) items. Due to the age of these items, there may be signs of use.

Article 7 Payment

7.1. The customer will receive a confirmation of their order from www.guitarage.nl via email, which includes the order information and the total amount of the order (item prices plus any shipping costs).

7.2. Payments are made by bank transfer or PayPal (outside Europe).

7.3. Once the payment is received, the order will be shipped.

Article 8 General Shipping

8.1. The items remain the property of www.guitarage.nl until the customer has fulfilled all payment obligations.

8.2. The shipping costs for both within and outside the Netherlands are calculated based on the number, dimensions, and weight of the items ordered.

8.3. Orders are shipped as packages via a recognized delivery company. Package shipments cannot be delivered to a P.O. box address.

8.4. The delivery times provided by www.guitarage.nl are indicative only. Exceeding any delivery period does not entitle you to compensation or the right to cancel your order or terminate the agreement.

8.5. All shipments are sent insured and registered.

8.6. www.guitarage.nl aims to offer orders for shipment within 2 working days after receiving payment.

8.7. www.guitarage.nl cannot be held liable for any loss, delay, and/or damage to items during shipping.

Article 9 Returns

9.1. Returns will only be considered by www.guitarage.nl if the purchased items clearly deviate from the description. The customer must notify www.guitarage.nl by email within 2 working days of receiving the order with a request for return. The return request must include the customer's name and item details. Unannounced returns will not be processed.

9.2. Returns that are not sufficiently stamped will not be accepted and will not qualify for a refund.

9.3. The costs and risks of the return shipment are the responsibility of the buyer.

9.4. The purchase amount will be refunded as soon as possible, in any case no later than fourteen days after the item has been received back in good order, undamaged, and in its original condition by www.guitarage.nl. If an item is returned that, in the opinion of www.guitarage.nl, has been damaged due to an action, use, or negligence of the customer or otherwise falls under the customer's risk, www.guitarage.nl will inform the customer of this. www.guitarage.nl reserves the right to refuse returns or to refund only a portion of the amount if there is a suspicion that the products have been used or damaged by the customer or third parties.

10.1. All questions can be directed to the email: info(at)guitarage.nl. www.guitarage.nl strives to answer your questions promptly.

Article 11 Privacy Policy

11.1. www.guitarage.nl respects the privacy of its customers and handles the personal data of the customer as carefully as possible.

11.2. All information regarding the personal data of the customer is carefully managed and stored in a database. The customer's data is only for internal use by www.guitarage.nl.

Article 12 Applicable Law and Competent Court

12.1. Dutch law applies exclusively to all rights, obligations, orders, and agreements to which these Terms and Conditions apply, as well as to these Terms and Conditions.

12.2. All disputes between the parties will be exclusively submitted to the competent court in the Netherlands.

Article 13 Liability

13.1. www.guitarage.nl is not responsible for consequential damage due to improper use or due to a defect that could not have been foreseen by www.guitarage.nl.

13.2. We package our items very well for shipping. However, if damage occurs during shipping, we are not liable for this.

13.3. Electronic devices are tested by www.guitarage.nl. However, given the age of our products (often several decades old), no technical guarantee can be provided.
